Peter Sherwen of Acreswall, 1819
Peter died on 7th Feb 1819 at Acrewalls, St. Bees. His Will was proved on 18th March 1819. ACT UPON PROBATE on the 18th day of March 1819:
Peter Sherwen, late of Acre Walls, husbandman, in the Parish of St. Bees, in the county of Cumberland, within the Archdeaconry of Richmond, in the Diocese of Chester, who departed this life on or about the (Seventh?) day of February, 1819, was proved in common form, and John Dickinson (daughter Elizabeth’s husband) of Hebburn (Kedburn?) Gill in the Parish of Arlecdon and William Nicholson of Nether Wasdale in the parish of St. Bees, yeomen (however?) being reserved for John Sherwen of Seascale in the parish of Gosforth, were sworn well and faithfully to execute and perform the same and so forth. And that according to the best of the Knowledge, Information and Belief of the said John Dickinson and William Nicholson, the whole of the goods, Chattels and Credits, of which the said testator Peter Sherwen died possessed, within the Archdeaconry of Richmond, in the Diocese of Chester (exclusive of what the said Testator might have been possessed of, or entitled to as a trustee, for any other Person or Persons, and not beneficially, and without deducting anything on Account of the Debts due and owing by and from the said Testator) were under the value of Four hundred and fifty pounds. This is the last Will and Testament of me, Peter Sherwin of Acrewall in the Parish of St. Bees and County of Cumberland, Husbandman, being in ----- following, (that is to say)
First I order my Will is that all my just debts and funeral expenses be paid, and I hereby nominate, constitute and appoint my brother, John Sherwin of Seascale in the parish of Gosforth; John Dickinson of Kidburn gill in the parish of Arlecdon and William Nicholson of Netherwasdale in the parish of St. Bees, all in the county of Cumberland, Yeomen, to be Executors in trust for this my last Will and Testament.
I order that my wife Ann Shirwen and my son John Shirwen keep in possession and remain upon the premises of Acrewalls which I now possess until my current lease expires which will be on the 25th day of March in the year 1822, and I further order that they jointly keep and maintain the rest of my unmarried family during that time, and also that they keep my Stocks, Goods, Chattels and personal estate of what kind or nature serves to be delivered to my aforesaid Executors at the end of the term equal to its present value. And if my said wife and son John be found by my Executors in trust to impair, damage, destroy or by any means lessen the value of my personal estate, that they, the Executors in trust shall at any time during the said term, or when they think proper, interfere in the management of my said property and order and ----- it to the greatest possible benefit of my surviving family as shall be hereafter mentioned.
Then I give and bequeath to my wife Ann Shirwen my best bed, Bedsteads and Bedclothes thereto belonging, six --- chairs and one elbow ---- Tables and my corner cupboard with the vessels and utensils it is accustomed to hold as it now stands, and also a set of fire-irons – and my will is that my said wife is to keep and maintain my unmarried children until they respectively attain the age of twenty-one years if they choose to reside with her.
As to the rest, residue and remainder of my personal property of what kind or nature ---- or whosoever, I order and my will is that my Stock, Crop, Husbandry, Utensils, Goods, Chattels to be sold within twelve months after the expiration of the said lease to discharge my just debts and defray my funeral expenses, and the rest, residue and remainder of my personal estate to be divided equally among my wife Ann Shirwen and my children, John Shirwen, Peter Shirwen, Ann Shirwen and Eleanor Shirwen, share and share alike to be paid by Executors in trust when my youngest daughter Eleanor attains the age of twenty-one years – and my will is that any of my last mentioned children may have possession of his or her share as they respectively attain the age twenty-one, by paying interest for the same to my wife at the rate of ninepence (or sixpence) to the pound --- until my said daughter Eleanor attains the age of twenty one provided my wife remains unmarried until that time but if my wife marries before that time my said four children shall possess their respective (legacies) free and without paying interest for the same. And if any of my four last mentioned children should happen to die before he or she so dying should be twenty one years of age then my will is that the share of him or her so dying shall be equally divided amongst the survivors.
